A bad investment......You've lost your lifesavings......There's nothing you can do......

...Or is there?

"These things happen...the market is unpredictable."

"If you're going to invest you have to handle the losses."

"You should have known better.  It's really your fault."

"Tough luck, but it's too late to do anything about it now.  Your money is gone."

"Investing is just a risky business."

Sound Familiar?

Well, investing in today's market does have some inherent risk, but unfortunately, many of us fall prey to the unscrupulous actions of our trusted financial advisors.  Americans lose over $1 billion each year at the hands of over-zealous stockbrokers.  And 95 percent of us who have experienced a loss never do anything about it.

The good news is you have legal rights.  If you've fallen victim to the deceptive or manipulative practices of an unethical broker, then The Law Office of Stuart R. Berkowitz, LLC may be able to help you recover your financial loss.

Just because you've lost money in the market doesn't mean someone has done something wrong.  Losses can occur simply as a result of mistaken judgment.  However, if you were not given enough information to make a sound judgment or if information was intentionally withheld from you, then your broker may have violated his duty to you.

Did your broker ever...

  • promise you or guarantee you a certain return?
  • misrepresent costs of an investment?
  • fail to inform you about the risk as opposed to the rewards?
  • encourage you to buy an investment unsuitable to your financial needs?
  • trade your account unnecessarily (churning)?
  • make unauthorized purchases for your account?

If you answered YES to any of the above questions and the action occurred within the past six years, then you may be able to recover your losses.

Fault or Fraud...

The law requires your advisors and stockbrokers to help you make prudent and informed judgments.  Unfortunately, not all financial professionals live up to these required standards.  Often times, broker recommendations are influenced by commission levels rather than quality of the actual investment.

Your broker has a duty to ensure every investment made on your behalf meets your specific financial needs and investment objectives.  You should never be subjected to an investment that is unsuitable to your needs.

What you can do...

Arbitration is the Answer!

You don't have to go to court to exercise your legal rights.  We all know litigation can be an expensive and lengthy process--sometimes taking years and years to recover.  Arbitration, on the other hand, is less formal, less expensive and less time consuming.  Arbitration is binding in the securities industry.

Plus, Arbitration cases are resolved by a three-person panel made up of lawyers and industry representatives who have been trained to understand the key issues in cases such as yours.  The panel listens to the facts in an informal setting and attempts to quickly make a "fair" decision.
